§ 311-5.02. Decision of Board.

The Board shall render a decision, based on a majority vote of the Board, within forty (40) days after termination of the public hearing, unless such time period is extended by written agreement of the Board and the applicant. The hearing is deemed terminated when all public testimony has been received and all information requested by the Board that it is entitled to receive has been submitted. In making its decision, the Board shall take into consideration the recommendations of local boards, but shall not be required to adopt same. The Board shall file its decision within fourteen (14) days in the office of the Falmouth Town Clerk, and it shall forward a copy of any comprehensive permit to the applicant or its designated representative and to the Department when it is filed.
